Here is an interesting proposal for lawmakers, and concerned citizens

 

 

THE “NO MORE VICTIMS” ACT OF 2007 

 INTRODUCTION: 

Due to the purported high rate of sex crimes and the public’s demand that the government take whatever steps necessary to protect the children from adults who prey on them, I would like to introduce the “No More Victims” Act of 2007. The “No More Victims Act” of 2007 picks up where Megan’s Law and others like it  left off. The common thread with all these laws is what to do after a crime has been committed and fails to address any preventative aspect. In order for there to be “No More Victims” our focus must now be on prevention of these crimes.

 

It has already been well established that the Federal Government and States have a “legitimate governmental interest” in protecting the public, especially the most vulnerable among us, America’s children. Additionally, the courts have ruled, and the general public has accepted, that the rights of victims and/or would be victims, take precedent over the rights of those that “may” pose some future threat to society based solely upon empirical data and risk assessments, which are tools that “predict” future behavior.

 

It has also been well established - and upheld  by numerous courts that what is currently known as the “Sex Offender Registry” is not a punitive scheme, but a regulatory one.

Designed to alert the community of those with a risk towards committing some future act. 

Given that upwards of 90 percent of new sex crimes are committed by someone who is NOT currently on the sex offender registry, not known to law enforcement, and is not on community notification , and cloaked in anonymity, lawmakers have a duty to adopt the following measures to put an end to sex crimes for once and for all.

 

Since lawmakers have a stated that they have a “legitimate governmental interest” in protecting the public and since the techniques proposed herein would guarantee upwards of a 100%, if not a full 100% rate of success, it is incumbent upon lawmakers to adopt this act, so that there can be “No More Victims”

 

 I introduce to you the following ACT, which shall be hereby known as the “No More Victims Act of 2007”.

 

 UNDER THE ACT: 

 

All persons, both male and female, age 18 and over must submit to a plethysmograph and given a risk assessment while under polygraph. The plethysmograph purports to have a 100% effectiveness rate in predicting who will offend, is FDA approved, and already in use in the United States. Given the recent high rate of offenses among teachers, clergy, governmental and law enforcement officials, and any other person in a position of trust or authority  I move to start with those individuals first, as well as with any other person that maintains a position where working among children whether paid or voluntary.

  

Based upon the results of the plethysmograph,  polygraph and an empirical risk assessment, each individual who cannot “pass” shall be placed on a public “high risk” registry along with their assigned risk level.

 The site must include the following:

1.      a current photo 

2.      risk level

3.      date of birth

4.      living address

5.      name of employer and work address

6.      If attending and educational facility, the name and location of said facility

7.      all e-mail addresses and online identifiers

8.      list any/all known deviations from currently accepted societal norms.

9.      Individuals who pose a risk must obtain a yearly driver’s license or state issued non-operating identification card. The image must, within 3 business days be submitted to the agency responsible for maintaining the sex offender website.

10.  ANYONE WHO REFUSES TO SUBMIT TO THE ACT WILL BE AUTOMATICALLY ASSIGNED A RISK LEVEL OF THREE AS THAT CAN ONLY BE AN INDICATION THAT THEY HAVE SOMETHING TO HIDE AND A REASON TO FEAR THIS ACT. 

In order to withstand any constitutional challenges which may arise, any prior criminal act which is discovered to have occurred via the risk assessment and prior to the enactment of this act cannot be held criminally liable based solely upon the information derived from the assessment. However, such acts must be considered when designating the risk level said individual poses to society.

 

We foresee no challenges in respect to constitutional rights violations as the sex offender registry is merely a tool for the public, to warn them of those that “may” pose some future risk to society and the intent is to prevent sex crimes. This “Act” merely expands the public’s awareness and would be a vital tool in the prevention of crimes as well as having the potential to catch those who have already committed crimes but have not been caught or prosecuted. Additionally, the courts have already ruled that registration is regulatory and not punitive in design and therefore The “No More Victims Act” will easily withstand constitutional challenges on that ground.

Results and Discussion

A survey by Kent State University 1995 (LORI L. OLIVER, GORDON C NAGAYAMA, RICHARD HIRSCHMAN) was conducted on a sample of 80 normal male volunteers using the "penile plethysmograph". The team carried out hundreds of tests exposing them to nude female adult and child (<12 years) images.

  • Over 1/4 (32.5% in fact) of the subjects exhibited penile arousal to pedophilic stimuli that equalled or exceeded arousal to adult stimuli.
  • 95% exhibited arousal to the female adult images (4 exhibited no arousal)
  • 88.7% exhibited arousal to the female child images. (9 exhibited no arousal)
  • 76.3% exhibited arousal to the contrasting images (Ten subjects exhibited no sexual arousal )
  • 3.7% of the subjects admitted to actual pedophilic masturbation and were removed from the sample results.

This study is probably the most comprehensive scientific study investigating pedophillia. The experiment was carried out under strict conditions so as to eliminate distortion of the results. Following the study a procedure was introduced to assess whether subjects might be able to consciously inhibit arousal. 46 subjects were able and 34 were unable to completely inhibit their sexual arousal in response to the slide that had been most arousing to them. There was however no significant deviation in the results between these two groups. There was also no significant deviation in the results between between subjects who exhibited a lower general arousability and the rest of the sample. It was agreed that a 3mm change in circumference consituted 'arousal'. Arousal was measured on baseline scales and with reference to previous studies.

It is interesting that the results for part of the study were INVERTED by stating those that were not aroused. Was this in an effort to hide the nature of the findings? 95% is the figure one would expect for arousability to adult female images but it seems the figures for pedophilic arousabilty were masked. 3.7% of the subjects were removed from the results because they admitted to pedophilic behaviour (ie masturbation). The study concludes that "sexual arousal to pedophilic stimuli occurs among a sizable minority of normal men who report no pedophilic behavior ". Since their findings clearly show that 88.8% were aroused by the child images the word should have been majority.

The results of surveys like this smash any theories that pedophiles are but a small minority. Combine this with what we know about internet habits and other factors and you no longer have a minority, like the gay community, you have a huge silent majority. Surveys like this suggest that something like 8 or 9 out of ten men are sexually attracted to young girls as well as women. Shocking? Not really. Women have known that instinctively for years. Women would pay a fortune for the skin, sparkling eyes and body of a 10-year-old. This is not an effort to undermine women - shapely women will always be attractive to men. It is those with slim girl-like figures however, that receive many times more attention.

Summary of results:

Subjects were recruited via a newspaper advertisement placed in the sports section of the Sunday edition of a newspaper.

  • 86 persons called to inquire about the study but did not schedule appointments to participate in the study.
  • 22 persons scheduled appointments but failed to appear.
  • 19 subjects withdrew from the study after the requirements were explained to them.
  • 80 subjects completed the study

Their mean age was 38.3 years.

52 subjects were Caucasian, 25 were African American, 2 were Hispanic, and I was Asian American.

The subjects' mean education was 14.1 years.

28 were never married; 26 were married; 18 were divorced; 6 were separated; and 2 were widowed.


All subjects were assessed with the penile plethysmograph. The experiement was carried out over 8 hours on two consecutive days. Slides of frontal views of nude prepubescent female children, nude adult females, and slides of clothed prepubescent female children were presented, two slides per category per session. Slides were presented for 4 minutes and times lapses were interspersed between slides to allow subjects to return to a state of non-arousal.


Self reported data:

  • 98% reported at least some sexual interest in adult women
  • 20% admitted at least some pedophilic interest

Measured results:

  • 95% exhibited arousal to the female adult images (4 exhibited no arousal)
  • 88.7% exhibited arousal to the female child images. (9 exhibited no arousal)
  • 76.3% exhibited arousal to the contrasting images (Ten subjects exhibited no sexual arousal )

Audiotape stimuli:

  • 81% exhibited arousal to the contrast audiotapes (15 subjects exhibited no arousal)
  • 90% exhibited arousal to the adult consenting audiotapes (8 exhibited no arousal)
  • 81% exhibited arousal to the child consenting audiotapes (15 exhibited no arousal)
  • 78.7% exhibited arousal to the child rape audiotapes (17 exhibited no arousal)
  • 78.7% exhibited arousal to the child aggression audiotapes (17 exhibited no arousal)

There were no tapes depicting adult rape or aggression.
