To Whom It May Concern;

My name is James (last name ommitted). I would first like to thank you for your time in reading this letter to better understand the matter at hand; a problem that I believe will be solved with wisdom and in a most dignified way.

I was born July 23, 1985 and I am now twenty years of age. I am now currently incarcerated in the Arizona State Prison system and have a Doc number of 187906. I am completing a five year sentence on the charge of "Sexual conduct with a minor attempt to commit", case number; 2003-0300-1800-18

I was seventeen when arrested by the Maricopa County and was given seven initial charges four charges of sexual misconduct with a minor and three charges of child molestation. These charges were not brought up by the victims, but by my own admittance. I was between the ages of fourteen and fifteen when the crimes were commited, and turned myself in July 5, 2003 at the age of seventeen in search for penance, counseling, and help for what I had done. Again, there were no complaints ever made by the victims or their families.

At the time of said crimes, and also upon my arrest I was living in Mesa Arizona. When questioned by the police, who made the initial report, I was never read my rights. Right before I was arrested and put in handcuffs, the two policeman told my Mom and step-father, Wendy and Felix Tenorio and me, that I would be home later that night. Not until I was brought in to see the detective to give a full account was I read my rights.

During my questioning with both the police and the detective, I was not accompanied by either parent or legal advisor. While being questioned because I was a minor and to find out what was going on. While being questioned, my mother Wedy Tenorio was called by an unknown woman at the Mesa Police station who informed my mother that I was being interrogated. My mother then insisted that she be with me while I was being questioned because I was a minor and to find out what was going on. The women at the police station then said it was impossible for her to see me, and that I would be home later that evening. All this can be sworn to in a court of law. After sitting in a small room for many hours with only a sprite to drink and a small bag of chips to eat, I was finally questioned.

During my plea negotiations I received many threats and promises, given by the prosecutor Angela Andrews, through my attorney Craig Henley. The most occurring threat was that people with cases like mine were sent to prison for life to make sure there was no re-offending. During my case and incarceration at Madison Street jail, I was priveledged with the ability to be released in my parent’s custody for a Saturday to be evaluated by two doctors, one with the DDS Family Services and the other a Dr Dianne Genco who worked under Dr Steven Gray. The reason behind this was to show the district attorney that trained doctors agreed that I was not a threat nor resistant to counseling, that I should receive such, and that I should not be incarcerated. This being affirmative by both doctors. I was then let out on every Tuesdays to continue counseling with the said Dr Genco.

Near the end of my case the prosecutor came forward with accusations of breaking the rules and then decided to take away my Tuesdays for multiple reasons, none of which she was able to provide with any evidence.

The Prosecutor then went on to tell my step-father Felix Tenorio, that if there was any mention in court of my Tuesdays being taken away or of her false accusations, she, the Prosecutor, would then take away my five year plea, resulting in more time. Again, all of which can be sworn to in a court of law.

This all accrued after a two year plea was offered, but also taken away. Whether it was an actual "written plea" or just a "verbal plea" it is unknown to me. But it did consist of two years county flat time, lifetime probation/registration, and a continuation of getting out each Tuesday, while incarcerated, if the probation departments deemed it alright to continue.

Angela Andrews also said, which she stated in court at my sentencing, that I would be able to receive counseling in prison. As of now, and ever since I arrived at A.D.O.C., there has been no available counseling with a certified doctor.

On one of my Tuesdays out I was given a "Risk assessment" test by Doctor Steven Gray. This test has many parts including a polygraph to see if I was a risk to the community and if my sexual likes and dislikes were in line and where they are supposed to be. I passed every element of the test. Included in the results of this test is a statement by Dr. Stevn Gray not saying "yes or no" to prison time, but leaning more toward the fact that it would do me more harm, and that I should get some counseling instead. Dr. Dianne Genco also wrote a letter tot he court stating that it would do me more harm than good to do any time and that I should receive counseling.

During my time in counseling I had to bring up more victims and acts that I had committed. There was somewhat of an "Unwritten law" that if I didn’t I would be deemed "Untreatable" and therefore receive more time. This, it seems, only added to the prosecutor’s conviction; for I was given two more charges of "Sexual Misconduct with a minor" on a new case number.

I was sentence to two charges of sexual Conduct with a minor attempt to commit" on one case number. For one charge I was given five years prison time, and the other I received lifetime probation.

Before I was arrested I had plans to complete high school, serve my church by going on a mission, and then go to U.C.L.A. to become a doctor in Neurology. Now that I am in prison I have received both my GED and a diploma from Westwood High School. Now that I have a felony on my record, I cannot achieve my life-long dream and hold a medical license.

I am now working towards my associate’s degree with Weber State University and am planning to get my doctorate in Theology, my hopes are that the laws will be corrected, that young adults will be given the chance to succeed, and that I, with a clear record will be able to achieve my medical license and save the lives of many.

Again, I would like to thank you for your time an consideration. I have no doubt that the decisions made will be of best judgement and from great meditation.
